General Terms and Conditions

The general terms and conditions of the Hyper Microplastic Filter website have been drawn up in accordance with the Estonian Consumer Protection Act (Tarbijakaitseseadus) based on the recommendations of the Chamber of Commerce and international codes of conduct for e-commerce. The terms and conditions of sale define the rights and obligations of customers when ordering products available on the hyper-filter.com website, as well as the business relationship between the supplier and the customer. The entire content of the website, regardless of its form (text, images, films, sounds, etc.), is protected by copyright. The content of the website may not be used for any purpose other than the user's personal viewing, unless the provider has given their prior written and express consent to the contrary. In the event of misuse, the user shall be held criminally and financially liable. By using the website www.hyper-filter.com, the user accepts and agrees to all provisions of the general terms and conditions. If you do not agree with these general terms and conditions, we urge you to immediately stop accessing the website. Please read the general terms and conditions and our privacy policy, which relates to your privacy and personal data. Product images are symbolic. Please read the content of the offer and promotional offers carefully before purchasing.

Intellectual property rights

The provider has all necessary rights to the trademarks and other products found on the website. The trademarks found on the website are protected in accordance with national and international legislation. By publishing trademarks and enabling the use of the website, the provider does not waive the rights arising from the trademarks. In the event of trademark abuse, the user shall be held criminally and financially liable. The entire content of the website, regardless of its form, is protected by copyright. The provider of the online store is the holder of all copyrights.

Online store

Users can make purchases via the website, which is accessible via the link: www.hyper-filter.com. The written general terms and conditions are an integral part of the contractual relationship between the provider and the buyer – the purchase agreement. By registering on the website or placing an order via the online store, the user confirms that they understand and accept the general terms and conditions. Users do not need to register to make purchases in the online store. The provider makes every effort to ensure that the information provided in the online store (product descriptions, photos, etc.) is accurate. Offers on the website are limited in quantity and time. The quantities of stock published on the website are for information purposes only and are subject to change without notice.

Prices and taxes

All prices are in EUR. Prices include value added tax (24% VAT) because we are a taxable entity. Item prices do not include delivery or postage costs. These are listed when calculating the order value before electronic confirmation of the order.

The store offers customers the following payment methods:

• bank transfer to the company account: SAPEO OÜ based on a quote/proforma invoice,
• credit card.
• PayPal

Payment via our payment system is secure, as it complies with security standards with an SSL certificate. All products are original. Special offers are valid until stocks are sold out. In the event of changes to prices or product descriptions, the seller will notify any customers who are in the process of placing an order.

Order cancellation

When the user places an order, they receive an email confirming receipt of the order. The user has the right to cancel the order before receiving an email notification from the provider that the shipment has been sent to the post office or ordered from the brand supplier. The contract or order is sent to the buyer at the email address they entered when placing the order. We store it in electronic form at the company's headquarters. The buyer may request a copy (invoice) via our contact address: info@sapeo.eu. The online store provides technical means for identifying and correcting errors before placing an order, namely, the website alerts the buyer if they have not filled in all the required fields. Before completing the order, a summary is available where the buyer can check and edit their entered data. In case of incorrect entry, the customer can correct the errors in the shopping cart. To cancel an order, the customer sends a message to info@sapeo.eu, where we confirm the cancellation. The cancellation request must include the user's first and last name, address, order number, and order date.

Withdrawal from the contract and return of goods

In accordance with the Estonian Consumer Protection Act (TKS) and the EU Consumer Rights Directive (2011/83/EU), a consumer who has already received the goods and withdraws from the contract must return them to the company or a person authorized by the company to receive the goods immediately, or at the latest within 14 days of notification of withdrawal from the contract. In the event of withdrawal from the contract, the company must refund all payments received from the consumer upon conclusion of the contract (placement of the order) within 14 days of receiving the goods. Refunds are not made in cash.

The buyer has the right to withdraw from the contract within 14 days without giving any reason for their decision. During this time, the buyer must notify the company of their withdrawal from the contract and their intention to return the goods. The product you wish to return must be unused, clean, and undamaged. Products sold in packaging must be returned in their original packaging with the original labels! In the event of withdrawal from the contract, the provider reserves the right to claim compensation for the reduced value of the goods. We recommend that you open the packaging carefully and keep it in its original condition, and keep the labels attached to the product until you are sure that the product is suitable.

Complaints and returns of products from abroad

Returns of products outside the territories where the warehouses are located are only possible with the original packaging, and the buyer bears the shipping costs. We will consider order cancellations within 12 hours of the order being placed, upon presentation of the invoice.

We will refund the purchase price to the specified transaction account no later than 14 days after receiving the application and the returned product. To refund the purchase price, we need the returned product (in the condition specified in the previous paragraphs) and the application form, which we will send you before the refund. If you have provided an incorrect transaction account, we will charge an additional fee of €100 to resolve the case with the bank and the unauthorized recipient.

Cash refunds are not possible.

For returns of products paid for by credit card, we will refund the purchase price for the returned product to your credit card. For returns of products that were paid for by cash on delivery or bank transfer, we will refund the purchase price to your transaction account. If the product has material defects, the user must notify the provider of the defect within the statutory period and describe the defect in detail in the defect notification and allow the provider to inspect the product. The provider is not liable for material defects in the product that become apparent more than two years after the product was delivered. By placing an order, the buyer agrees that if they do not accept the delivery, SAPEO OÜ will charge the buyer for the postage of the returned package and the costs of processing the order. The buyer can contact us for help in case of problems. The buyer can submit a complaint to the following e-mail address: info@sapeo.eu. The complaint handling process is confidential. The provider will confirm receipt of the complaint within five working days and inform the buyer of the progress of the process within the following eight days. The provider will make every effort to resolve any disputes amicably. If an amicable resolution cannot be reached, the court in Tallinn shall have jurisdiction to resolve all disputes between the provider and the customer. The costs associated with returning goods in the event of withdrawal from the contract shall be borne by the buyer.

Warranty

The provider sells products of verified quality. The warranty period is 10 years from the date of issue of the invoice. The warranty can be claimed with the attached invoice, provided that the product has been used correctly and original filter discs have been used. All products are original.

Disclaimer

The provider makes every effort to ensure that the content published on the website is accurate and correct. The user must ensure that their equipment is adequately protected before entering the online store. The provider reserves the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or obstructing the use of the online store. The provider is not liable for any loss, damage, or costs incurred by the user due to the cessation of the online store's operation.

Legal notice

The court in Estonia shall have jurisdiction to resolve any disputes. In accordance with the law, the provider does not recognize any out-of-court consumer dispute resolution body as competent to resolve consumer disputes that consumers may initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act. The invalidity of any general term shall not affect the validity of the other terms. In accordance with the Tarbijakaitseseadus (TKS – Consumer Protection Act), which implements EU Directive 2013/11/EU on alternative dispute resolution for consumer disputes, the buyer may submit a request to initiate out-of-court consumer dispute resolution proceedings via the European platform.
